PSRT5090 - Mental Health and The Law
 
Course Description
This course is designed to introduce students to some of the major legal concepts, issues and cases relating to mental health. Students will discuss the implications of these cases for their professional practice including issues dealing with involuntary civil commitment, the right to or conditions of treatment, informed consent, confidentiality and duty to warn, and the right to refuse medication.
 
Credits/Modes of Instruction
Credits:  1
Lecture, classroom-based presentations and discussions.
 
Prerequisites
Admission to the doctoral program or permission of the instructor.
 
Course Goals and Outcomes:
Goals
Students will become conversant in the major cases effecting involuntary civil commitment, the right to or conditions of treatment, informed consent, confidentiality and duty to warn, and the right to refuse medication. In addition, they will have a basic understanding of when these issues are germane to their own professional practice and research.
 
Outcomes
By the end of this course, students will be able to:
1.Understanding of the seminal issues underlying mental illness and the law.
2.Describe case precedents in the following areas:
a.involuntary civil commitment
b.right to treatment
c.right to conditions of treatment
d.informed consent
e.confidentiality
f.duty to warn
g.right to refuse treatment
3.Apply these legal principles to professional practice, research, and professional ethics.
4.Understanding of how the legal system approaches and adjudicates the issues outlined above.
